California Governor Vetoes Bill on Gender Affirmation in Child Custody Cases
Governor Gavin Newsom of California has vetoed a bill that would have required judges to consider a parent’s affirmation of their child’s gender identity when making custody and visitation decisions. The bill, introduced by Assemblymember Lori Wilson, aimed to include gender affirmation as a factor among many that courts already consider in custody proceedings.
Newsom’s decision to veto the bill has sparked controversy and disappointment among its supporters. However, the governor explained his rationale, stating that while he is committed to advancing the rights of transgender Californians, he is cautious about dictating legal standards for the judicial branch to apply.
The bill would not have prioritized a parent’s affirmation of their child’s gender identity over other factors in custody cases. Assemblymember Lori Wilson, who has a transgender son, emphasized that affirmation looks different for each child and varies with age.
Supporters of the bill argue that including gender affirmation in custody decisions would protect the mental health and well-being of transgender children. They believe that a non-affirming parent could have a detrimental impact on the child’s development and overall happiness.
On the other hand, opponents, including every Republican in the Senate, believe that the bill interferes with parental autonomy. They argue that such legislation could exacerbate conflicts between parents and worsen the situation for the children involved.
This veto comes at a time when transgender rights are at the center of intense political battles across the United States. These battles involve issues such as bans on gender-affirming care, trans athletes’ participation in sports, and parental notification regarding children’s gender identity.
In addition to vetoing this bill, Governor Newsom also rejected a measure that sought to require human drivers on self-driving trucks and another one that aimed to restrict sharing information about incarcerated immigrants with federal officials.
